These general terms and conditions of sale govern both the use of the internet portal https://valerysun.com and all transactions involving merchandise between Valeria Prusakova (hereinafter “valerysun”, “the seller” or “the Website”) and customers.

GENERAL INFORMATION

In compliance with the duty of information provided in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE) of July 11, the following general information about this website is provided below:

The buyer

The buyer is informed that acceptance of the offer obligates them to pay for the merchandise. Once they have chosen the product they wish to purchase, the buyer accepts these terms and conditions by validating them by clicking “Accept.”

The seller

The seller will assume any risks that the product may suffer during transport until it is delivered to the consumer.

Payment and pricing information

At checkout, the buyer chooses between the various payment methods offered by Stripe, PayPal, or WooPayments.

Once the full payment has been made, the customer will receive an email confirming their purchase. If you require an invoice, please contact the seller directly at hola [at] valerysun.com.

The characteristics of the Products and their prices are those shown on the screen. The Products or services will be available for sale while supplies last. The prices indicated on the screen are in euros, include VAT, and are current.

In all cases, the sales contract between the buyer and the seller is subject to the condition that the Product is available and payment is made in full. The seller undertakes to confirm or deny the availability of the product ordered by the buyer within a maximum period of 15 days. If the same product is purchased by multiple buyers at the same time, it will be sold to the first buyer to complete their order.
If, within 15 days from the date of order validation, the seller does not notify the product’s availability, or if the buyer does not complete payment within the same period, the contract between the buyer and the seller will be dissolved and each party will be released from its obligations.

Shipping

The cost of all shipping to the peninsula (including Portugal) will vary depending on the destination, size, and weight of the product purchased. The amount will be specified during the checkout process before making the payment.

Shipping is done between Tuesdays and Fridays. Orders placed on Saturdays, Sundays, and Mondays will be shipped the following Tuesday following purchase.
Shipping Times:
– Domestic shipping time: 4-8 business days
– International shipping time: 14-30 business days
– International shipping time: varies by country. Please inquire if urgent.

For international shipments to the Canary Islands, Ceuta, and Melilla, shipping costs will also vary depending on the destination, size, and weight of the product purchased. Destination taxes, such as duties and other taxes, when applicable, will be the recipient’s responsibility and will be paid at the destination. Valerysun.com is not responsible for these additional costs.

For bank transfer payments, and to expedite shipping, we recommend that customers send proof of payment to the following email address: hola [at] valerysun.com. Valerysun.com reserves the right to request a copy of your ID or passport to confirm your identity.

All shipments include a tracking number so customers can check the status of their order. Shipping times may vary depending on the destination.

If the buyer wishes to insure the goods for the full purchase price (up to a maximum of €5,000) plus any damage, loss, or malfunction, they must contact the seller immediately by email or phone to inform them of the situation. The cost of the insurance will be equivalent to 2% of the value of the goods, although in special cases it may exceed this percentage.

Valerysun is not responsible for errors or damages caused during delivery when the delivery address entered by the customer does not match the delivery location desired by the customer.

Delivery is considered complete from the moment the work has been made available to the client at the delivery location indicated by the client.

If the buyer is absent at the time of delivery of the artwork to the address indicated by the buyer, the carrier will leave a notice indicating how to proceed to arrange a new delivery. If, after eight (8) calendar days from the date of this first notice, the customer does not contact the carrier to arrange a new delivery date, the artwork will be returned to Valerysun.com and the customer must be responsible for the shipping and return costs. Shipping costs for items to be exchanged or returned by mail will be borne by the customer, and under no circumstances will Valerysun.com accept returns sent postage due.

Returns or exchanges

The buyer has the right to return the purchased item within 14 calendar days. This period begins on the day the buyer receives the purchased items.

The buyer must return the goods within 14 days of communicating their intention to withdraw. Return shipping costs will be borne by the buyer. The seller will only be responsible for return shipping costs in the case of defective merchandise, in which case the buyer must notify us within 24 hours of receiving the order by email to the address indicated above.

If the buyer requests a return within the deadline (14 calendar days), the item’s price will be refunded within 14 days. The buyer will have the option, if desired, to receive a purchase voucher in the store for the amount of the returned product or exchange it for an item of equal value.

Any return of purchased items by the buyer must be carefully packaged.
The buyer must return the product with all contents of the original packaging and in perfect condition, free from defects, breakage, or deformities that affect the integrity of the work.

Returns will not be accepted if the items are stained or damaged. When returning frames, special care will be taken to ensure they are in the same condition as when they were sent to the buyer.

Shipping costs for items to be exchanged or returned by mail will be borne by the customer, and under no circumstances will Valerysun.com accept returns sent postage due.
